District bans 'sex-based' clubs

Officials have said the new policy, which takes effect immediately, aims to ban clubs that challenge the district's abstinence-only education.

In August, when the school board took the first of two votes needed to adopt the policy, an attorney for the American Civil Liberties Union threatened more legal action should the district use the policy to keep the Gay-Straight Alliance of Okeechobee High School from meeting on campus.

The ACLU represents Okeechobee High School graduate Yasmin Gonzalez and the club, who sued the district last year, claiming officials violated federal law by not allowing the club to meet on school grounds. According to the Equal Access Act, if a public school allows one extracurricular club to meet on campus, it must allow all clubs to meet.

A judge ruled in April that the Gay-Straight Alliance can meet on campus as the lawsuit works its way through the court.

„The rule itself just seems like it's bigoted and an attempt to make an end run around what the judge has already ruled and what the Equal Access Act requires,“ said Brandon Hensler, a spokesman for the ACLU.

District Assistant Superintendent Ken Kenworthy said the club still will be allowed to meet until the case is settled. As to whether the alliance qualifies as a „sex-based“ club, as district officials have claimed in court filings, that will be determined by the judge's ruling, Kenworthy said.

In his April ruling, U.S. District Judge K. Michael Moore said that the school board's attorneys had failed to show that the alliance was a „sex-based club“ that would expose students to obscene or explicit material.

According to the ACLU, the club aims to provide a safe environment for students to talk about homophobia and to promote tolerance of one another, regardless of sexual orientation.
